Whether you agree with Orson Scott Card or not. J.K. Rowling and all authors borrow from each others works. The question for the courts is, is the publication of the 'Lexicon' 'fair use' or not.

For Card's view.
Mine after reading the online 'Lexicon' is that with a very few shortenings of the quotes, this book is ok.
After all, most of the mythical beasts have been used by previous authors going back to the Greeks and Romans and many of the places mentioned in these books exist in the real world or again in older myths.
